Terms of Service
Agreement and eligibility
These Terms govern access to the Jury Verdicts Northwest website, publications, research application, searches, case documents, and upload tools (the “Service”). By creating an account, purchasing access, or uploading material after acceptance is enabled, you agree to the version presented at that action. You must be at least 18, able to form a binding agreement, and authorized to act for any firm or organization whose account you use. Do not use the Service if you do not agree.
Accounts and responsible use
Provide accurate information, protect credentials, and promptly report suspected misuse. An account is for the licensed person or organization and may not be shared outside the purchased allowance. You are responsible for activity under your account unless you promptly notify us of unauthorized access.
You may use the Service for lawful legal research, case evaluation, and related professional work. You may not interfere with security, evade access or usage controls, probe the Service without authorization, introduce harmful code, impersonate another person, use the Service to violate privacy or other rights, or use results in a misleading or unlawful way.
Memberships, searches, and expiration
Your order or account page identifies the membership period, included publications, user seats, search or download allowance, and any renewal terms. Allowances apply only during the stated period, are not cash, and expire when that period ends unless the order expressly says otherwise. A single-search purchase permits the stated search and associated results during its stated access window. Publication subscriptions and research memberships are separate unless the order combines them.
We may apply reasonable technical limits needed to enforce the purchased allowance and protect service availability. A material plan change will be disclosed before renewal or a new purchase.
Payments and refunds
Prices, taxes, billing period, and renewal terms appear before an actual charge. PayPal is the planned launch processor. The current preview does not charge or create a paid plan. Once checkout is enabled, you authorize the displayed charge and the payment provider’s processing. You remain responsible for taxes and valid payment information.
Except where law requires otherwise or JVNW states a different policy at checkout, fees are nonrefundable after access, a search, or a publication benefit is delivered. Contact us promptly about a duplicate or incorrect charge. We may correct billing errors and will honor any mandatory cancellation or refund right.
Uploads and your authority
You retain ownership of material you upload. You represent that you have authority and all permissions needed to provide it, including material containing personal, confidential, health, financial, or court information. Do not upload material subject to a sealing order, protective order, privilege, confidentiality duty, or other restriction that bars JVNW’s receipt and processing.
You grant JVNW a nonexclusive license to store, copy, process, extract, review, format, and use uploaded material to operate the Service and, when the submission is for publication and you are authorized to grant it, to prepare and publish a JVNW case report. Uploading does not guarantee publication. We may quarantine, reject, or remove material that cannot be validated or that presents legal, privacy, security, or quality concerns.
No scraping or redistribution
JVNW publications, authored case reports, database organization, search results, site copy, and branding are owned by JVNW or its licensors and are protected by law. Your license is limited, revocable, nonexclusive, and nontransferable. You may download and use individual results for your own licensed professional work.
You may not scrape, crawl, harvest, bulk download, systematically copy, republish, sell, sublicense, build a competing dataset from, train a model on, or redistribute substantial portions of the Service. You may not remove notices or use automated access except through a written JVNW API agreement. Ordinary internal work product may quote or cite reasonable portions with attribution.
Suspension and termination
We may suspend or limit access to protect users or the Service, respond to suspected fraud or abuse, enforce an allowance, address nonpayment, comply with law, or investigate a material breach. When practical, we will give notice and an opportunity to cure. We may terminate for a serious or repeated breach. You may stop using the Service and request account closure; amounts already due and provisions that by their nature should survive will remain in effect.
Service availability and changes
We work to keep the Service accurate and available, but archives, provider systems, source records, maintenance, and network conditions can cause delay, error, or interruption. We may improve or change features while preserving paid access in substance during its stated term. We do not promise uninterrupted operation or that every relevant case is in the archive. Please report a suspected record error so it can be reviewed against the underlying report.
Research service, not legal advice
The Service provides legal-research source material and tools. It does not provide legal advice, form an attorney-client relationship, predict a result, replace review of current law and primary sources, or establish the value of a claim. AI-assisted output is a research aid and must be checked against the cited case report. You are responsible for your professional judgment, filings, deadlines, advice, and use of results.
Disclaimers and limitations
To the maximum extent allowed by law, the Service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, noninfringement, or a guaranteed legal outcome. Nothing here excludes a warranty or remedy that cannot lawfully be excluded.
To the maximum extent allowed by law, JVNW and its owners, employees, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. Their combined liability arising from the Service will not exceed the greater of $100 or the fees you paid JVNW for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited or to liability that cannot legally be limited.
Governing terms and contact
Washington law governs these Terms without regard to conflict-of-law rules, except to the extent another law must apply. State and federal courts serving Snohomish County, Washington will have exclusive venue where that choice is enforceable. If one provision is unenforceable, the rest remains effective. A waiver must be express. These Terms, the applicable order, and the Privacy Policy are the complete agreement about the Service; an order controls only where it expressly conflicts.
